NOTICE OF SUBSTITUTE TRUSTEE'S SALE WHEREAS, by Deed of Trust dated November 30, 2010 and recorded on November 30, 2010, in Book T495, Page 390 in the Register's Office of Rhea County, Tennessee (the "Register's Office"), as modified by a Modification of Deed of Trust dated December 29, 2015, recorded January 29, 2016 in Book T558, Page 868 and as further modified by modification of, the Deed of Trust dated March 6, 2019, recorded in Book T606, Page 503, all in the Register's Office (collectively, the "Deed of Trust"), HERITAGE RESIDENTIAL HOME FOR THE AGED, LLC, a Tennessee limited liability company (the "Borrower"), conveyed to Investors Title Company, Trustee for the benefit of FirstBank, a Tennessee banking corporation ("Lender"), the property therein described (the "Property"), to secure payment of a Multipurpose Note and Security Agreement dated November 30, 2010, in the original principal amount of Three Hundred Twenty-One Thousand Ninety-Eight and 19/100 Dollars ($321,098.19), executed by Borrower to the order of Lender (as amended, modified and extended, the Note"). Lender remains the holder of the Note and the Deed of Trust. WHEREAS, Rachel E. Edwards was appointed successor Substitute Trustee under the terms of the Appointment of Substitute Trustee executed by Lender on December 10, 2019, and recorded on December 11, 2019 in Book T619, Page 668, in the Register's Office, with all the rights, powers and privileges of the original trustee named in the Deed of Trust. WHEREAS, default having been made in the payment of the Note, which remains unpaid and secured by the Deed of Trust, and in the performance of covenants contained in the Deed of Trust to which reference is made for recital of terms and conditions, and wherefore Lender, the lawful owner and holder of the Note and Deed of Trust, has declared the entire balance thereon due and payable. NOW, THEREFORE, pursuant to the authority vested in me as Substitute Trustee, I shall, at the request of the owner and holder of the Note and Deed of Trust, at 10:00 o'clock a.m. prevailing time on January 29, 2020, offer for sale at public outcry to the highest and best bidder for cash, at the front door of the Rhea County Courthouse, Dayton, Tennessee in bar of all statutory and common law equities of redemption, dower and homestead and all other rights and exemptions of every kind, the real estate located at 141 Couchwood Drive, Dayton, Tennessee, which is more particularly described in the Deed of Trust referenced above and the Special Warranty Deed to Borrower recorded in Book T358, Page 124 in the Register's Office. SUBJECT TO: (a) any governmental zoning and/or subdivision ordinance or regulation in effect thereon; (b) restrictions, conditions, reservations, easements, and stipulations as set forth in instrument of record in Plat Book 3, Page 723 in the Register's Office; (b) 15 foot Sewer Easement, Construction and Temporary Construction Easements, Slope Easement, and Power Lines, all as shown, described or noted on recorded plat; (c) slope, work area and drainage easements described in Parcels 2, 3, 4, 5 and 6 in deed to State of Tennessee recorded in Book 221, Page 75 in the Register's Office; and (d) easements granted to City of Dayton, Tennessee, in documents recorded in Book 226, Page 558 in the Register's Office. County taxes for the year 2017 are now delinquent and due and payable in the amount of $212.09 for Parcel 096 109.01; City of Dayton taxes for the year 2017 are now delinquent and due and payable in the amount of $82.46 for Parcel 096 109.01. County taxes for the year 2018 are now delinquent and due and payable in the amount of $1,977 for Parcel 096 109 and $132.00 for Parcel 096 109.01; City of Dayton taxes for the year 2018 are now delinquent and due and payable in the amount of $575.51 for Parcel 096 109 and $38.50 for Parcel 096 109.01. County and City of Dayton taxes for the year 2019 are due and payable. For prior title, see Warranty Deed recorded in Book T358, Page 124, in the Register's Office. Tax Map No. 096-109 and 096-109.01. The sale will be made subject to all prior liens, easements, covenants, conditions, encumbrances, and restrictions that may exist, including, without limitation, any unpaid ad valorem taxes or other taxes, and also subject to any right to redemption that may otherwise exist. . The Substitute Trustee makes no covenant of warranty or seizing, but will sell and convey as Substitute Trustee only. The sale will be made for the purpose of paying the indebtedness secured by the Deed of Trust and the proceeds thereof will be applied as provided by the terms of the Deed of Trust.
